These Terms of Service govern your access to and use of the Farm Couture website, including any purchases made through the website.

Throughout these Terms, “Farm Couture,” “we,” “us,” and “our” refer to Seger Holdings LLC, doing business as Farm Couture. “You” refers to any person who visits the website, creates an account, submits information, or purchases a product from us.

By accessing our website or purchasing from Farm Couture, you agree to these Terms of Service. If you do not agree to these Terms, you should not use the website.

1. Use of Our Website

You may use this website only for lawful, personal, and noncommercial purposes unless we have provided prior written authorization for another use.

By using the website, you represent that you are at least the age of majority in your state or jurisdiction of residence or that you are using the website with the permission and supervision of a parent or legal guardian.

You agree to provide current, complete, and accurate information when placing an order or creating an account.

You are responsible for maintaining the confidentiality of your account information and password and for all activity conducted through your account.

2. Product Information

We make reasonable efforts to present our products, colors, materials, measurements, descriptions, and photographs as accurately as possible.

Actual colors may vary slightly depending on your screen, device settings, lighting, photography, fabric dye lot, and production variation. Slight differences in color, texture, measurements, placement, and finishing may occur and are not necessarily considered defects.

Garment measurements and size charts are provided as general fit guidance. Fit may vary based on body shape, personal preference, fabric, and garment construction.

We reserve the right to update product descriptions, specifications, pricing, and availability at any time.

3. Pricing and Taxes

All prices are listed in U.S. dollars unless otherwise stated.

Applicable sales tax will be calculated and displayed during checkout based on the shipping destination and applicable law.

Prices, promotions, and product availability may change without notice. A price change will not affect an order that we have already accepted.

Promotional offers may be subject to additional terms, expiration dates, product exclusions, and purchase requirements. Unless expressly stated otherwise, promotions cannot be combined.

4. Orders and Order Acceptance

Submitting an order does not guarantee that the order has been accepted.

An order confirmation acknowledges that we received your order. We reserve the right to accept, decline, limit, or cancel an order for reasons including:

• Product or size unavailability
• Incorrect product or pricing information
• Payment authorization problems
• Suspected fraud or unauthorized activity
• Unusually large quantities
• Suspected purchasing for unauthorized resale
• Shipping restrictions
• Errors affecting the order

If we cancel an order after payment has been processed, we will issue a refund to the original payment method.

Products sold through the Farm Couture retail website are intended for personal use and not for commercial resale. Approved wholesale customers must purchase through our authorized wholesale channels.

5. Payment

By submitting payment information, you represent that you are authorized to use the selected payment method and authorize us and our payment service providers to charge the total amount shown at checkout.

Payment information may be processed by third-party payment providers and is also subject to those providers’ terms and privacy practices.

We are not responsible for fees charged by your bank, credit card issuer, payment provider, or other financial institution.

6. Shipping and Delivery

Orders are shipped according to our current Shipping Policy, which is incorporated into these Terms by reference.

Shipping and delivery estimates are provided in good faith. When we provide a shipping timeframe, we will make reasonable efforts to ship within that timeframe.

If we become aware of a material delay, we may contact you with an updated timeframe and any choices required by applicable law.

Farm Couture is not responsible for delays caused by carriers, severe weather, natural disasters, incorrect or incomplete addresses, customs processing, transportation interruptions, or other circumstances beyond our reasonable control.

Customers are responsible for providing an accurate and complete delivery address. 

Farm Couture is responsible for packages lost while in transit. Once tracking confirms delivery to the address provided at checkout, Farm Couture is not responsible for packages that are lost, stolen, or misplaced after delivery.

If your package is marked delivered but cannot be located, please check all entrances and delivery areas, confirm the shipping address, ask household members and neighbors, and contact the carrier directly to begin a missing-package investigation.

Farm Couture will provide reasonable assistance and supporting shipment information when needed. Replacement or refund decisions will be made after the carrier investigation and are not guaranteed when tracking confirms successful delivery.

7. Returns, Exchanges, and Refunds

Returns, exchanges, store credits, and refunds are governed by our current Returns & Exchanges Policy, which is incorporated into these Terms by reference.

By completing a purchase, you agree to the eligibility requirements, return window, item-condition standards, return-shipping charges, final-sale restrictions, and processing procedures described in that policy.

Items marked Final Sale are not eligible for return, exchange, or store credit except where required by law or when the item is confirmed to be damaged, defective, or incorrect.

Nothing in these Terms limits any consumer right that cannot legally be waived.

8. Gift Cards and Store Credit

Farm Couture gift cards and store credits may be used only toward eligible purchases from Farm Couture.

Gift cards and store credits:

• Are not redeemable for cash except where required by law
• Cannot be used to purchase additional gift cards unless permitted by us
• May not be resold or transferred for value
• May be canceled if obtained or used fraudulently
• Must be protected by the recipient as they would protect cash

We are not responsible for lost, stolen, or improperly used gift card codes except where required by law.

9. Promotions, Discount Codes, and Gifts With Purchase

Discount codes must be entered at checkout and cannot normally be applied retroactively after an order has been submitted.

We reserve the right to modify, suspend, or end a promotion at any time, subject to honoring orders already accepted under the published promotion.

A gift with purchase is available only while supplies last and may be subject to qualifying purchase requirements. If merchandise is returned and the remaining purchase no longer qualifies for the gift, the gift must also be returned unused or its stated value may be deducted from the refund, to the extent permitted by law.

10. Intellectual Property

The website and its contents are owned by or licensed to Farm Couture and are protected by applicable intellectual-property laws.

Protected content includes, without limitation:

• The Farm Couture name and branding
• Logos, crests, icons, and trademarks
• Product names and collection names
• Original garment designs and design details
• Photography, video, graphics, and artwork
• Website text, editorial content, and product descriptions
• Page designs, layouts, and other creative materials

You may view and use the website for personal shopping purposes. You may not reproduce, copy, distribute, modify, publish, sell, license, scrape, commercially exploit, or create derivative works from our content without prior written permission.

Nothing on the website grants you ownership of or a license to use Farm Couture intellectual property except for the limited personal use expressly permitted by these Terms.

11. Reviews, Comments, and Submitted Content

You may have the opportunity to submit reviews, photographs, comments, feedback, questions, or other content.

You retain ownership of your original content. By submitting content to Farm Couture, you grant us a nonexclusive, royalty-free, worldwide license to use, reproduce, edit, publish, display, distribute, and share that content in connection with our website, products, customer service, social media, and marketing, subject to applicable law.

You represent that:

• You own or have permission to submit the content
• The content is truthful and based on your genuine experience
• The content does not infringe another person’s rights
• The content is not unlawful, threatening, abusive, defamatory, obscene, fraudulent, or misleading
• The content does not contain malicious code, spam, or unauthorized advertising

We may decline, remove, or moderate submitted content at our discretion, but we are not obligated to monitor every submission.

12. Prohibited Conduct

You may not use the website:

• For an unlawful or fraudulent purpose
• To violate another person’s intellectual-property or privacy rights
• To submit false, misleading, or deceptive information

By using the website, you acknowledge that information may be processed as described in the Privacy Policy and by service providers necessary to operate the website, process payments, fulfill orders, communicate with customers, prevent fraud, and provide requested services.

Marketing emails and text messages are subject to the consent choices and unsubscribe methods described at the time of enrollment and in our Privacy Policy.

15. Website Availability and Disclaimer

We work to keep the website accurate, secure, and available. However, we do not guarantee that the website will always be uninterrupted, error-free, secure, or free from harmful components.

The website may occasionally be unavailable because of maintenance, technical problems, platform interruptions, updates, or circumstances outside our control.

Except for warranties that cannot legally be excluded, the website and its general content are provided on an “as available” basis.

This disclaimer does not eliminate obligations relating to products that are damaged, defective, materially misdescribed, or otherwise protected under applicable consumer law.

16. Limitation of Liability

To the fullest extent permitted by law, Farm Couture and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from your use of or inability to use the website.

To the fullest extent permitted by law, our total liability for a claim relating to a particular product or order will not exceed the amount you paid to Farm Couture for the product or order giving rise to the claim.

These limitations do not apply to liability that cannot legally be limited or excluded, including liability arising from fraud, willful misconduct, or other circumstances protected by applicable law.

Some jurisdictions do not allow certain liability limitations. In those jurisdictions, these limitations apply only to the maximum extent permitted.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Farm Couture and its owners, employees, contractors, affiliates, and service providers from claims, damages, liabilities, and reasonable expenses arising from:

• Your unlawful or unauthorized use of the website
• Your material violation of these Terms
• Content you submit that violates another person’s rights
• Fraudulent activity conducted through your account

This provision does not require you to indemnify Farm Couture for Farm Couture’s own negligence, unlawful conduct, or willful misconduct.

18. Events Beyond Our Control

Farm Couture will not be responsible for a failure or delay caused by circumstances beyond our reasonable control, including natural disasters, severe weather, fire, flood, war, civil unrest, government action, labor disruptions, transportation interruptions, carrier delays, utility failures, internet outages, supplier disruptions, or platform failures.

We will make reasonable efforts to communicate with affected customers and fulfill, reschedule, or refund affected orders as appropriate.

19. Termination

We may suspend or terminate your access to the website if you materially violate these Terms, misuse the website, engage in fraudulent activity, threaten our employees or customers, or interfere with our operations.

Termination does not affect rights or obligations that arose before termination, including payment obligations, intellectual-property protections, liability limitations, and dispute provisions.

20. Severability and Waiver

If any provision of these Terms is found unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.

Our failure to enforce a provision on one occasion does not waive our right to enforce it later.

21. Entire Agreement

These Terms, together with our Returns & Exchanges Policy, Shipping Policy, Privacy Policy, and any additional terms displayed during a promotion or purchase, constitute the entire agreement between you and Farm Couture regarding use of the website and retail purchases through it.

If a product page or promotion contains specific terms that conflict with these general Terms, the more specific terms will govern that product or promotion.

22. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.

Any dispute that cannot be resolved informally will be handled in a court with lawful jurisdiction in Colorado, except where applicable consumer law gives you the right to bring a claim in another jurisdiction.

Nothing in these Terms deprives you of mandatory consumer protections provided by the laws of your state or country of residence.

23. Changes to These Terms

We may update these Terms periodically to reflect changes to our business, website, services, or legal obligations.

The revised Terms will be posted on this page with an updated effective date. Changes will apply prospectively unless applicable law requires otherwise.

Your continued use of the website after revised Terms become effective constitutes acceptance of the revised Terms.
